Fine Sanman $6G for Moonlighting on Job And While in Uniform

The city Conflicts of Interest Board July 28 announced that a Sanitation Worker had been suspended without pay for four days and fined more than $6,000 for working for a private company on city time in his agency uniform.

Albert Passaretti, an eight-year veteran of DSNY, was employed as a mystery shopper for a private company, Contemporary Staff Solutions, during his shift and while wearing his city uniform. The Conflicts of Interest Board found that Mr. Passaretti's conduct violated city law, which bars public servants from using city time and resources to pursue private activities.

Contemporary Staff Solutions employed Mr. Passaretti for more than three years. On March 25, DSNY served the employee with disciplinary charges. He violated the city Administrative Code and the DSNY Code of Conduct, according to the Conflict of Interest Board.

He agreed to a four-day suspension without pay, which is worth $974, which will be served at a date determined by DSNY, and waived his right to an appeal. He was also fined 26 days' pay, or a total of $6,332. One day's pay will be deducted every pay period over the course of a year.

Five days earlier, the Conflict of Interest Board fined a Sanitation worker $7,307, the equivalent of 30 days' pay, for using a city vehicle for outside employment as a security guard.

City workers who need clarification about the Conflicts of Interest Law can call the board at 212-442-1400.
