Contest Firing Of: 3 ACS Staffers

By HOWARD MEGDAL

The president of the union representing three unidentified Administration for Children's Services Caseworkers who were fired last week over their handling of seven-year-old Nixzmary Brown's case expressed optimism that an arbitrator will overturn the agency's ruling.

"We're not even surprised," District Council 37 Local 371 President Charles Ensley said in an April 17 phone interview. "It was clear [ACS Commissioner John B. Mattingly] did not have the political will to defend his workers."

The union had the option to appeal the decision to the city's Office of Labor Relations, but chose instead to find a mutually agreed-upon arbitrator, who will make a binding decision.

"We are completely confident that any impartial that hears these cases will vindicate these workers," Mr. Ensley said.
